The death of a 17-year-old boy who was fatally shot in Marrero last week was a justifiable homicide, according to the Jefferson Parish Sheriff's Office. 

Terius Brue was gunned down in the 2000 block of Mather Drive on the morning of July 14. 

But Brue was shot after he allegedly fired first at Richard Harris, 20, of Marrero, said Capt. Jason Rivarde, a Sheriff's Office spokesman. ...

Homicide detectives determined that Brue entered the Mather drive home of a former girlfriend through a window while armed with a gun just before 11:30 a.m., according to authorities. Harris, who was inside the residence, helped the ex-girlfriend get Brue out of the house. 

Once outside, Brue is accused of shooting at Harris, who was not injured. 

"Harris returned fire," Rivarde said. ...

However, Harris was arrested on charges of being a convicted felon in possession of a firearm and obstruction of justice.

3/31/17 Dayton Daily News:

Dayton police said Martin’s shooting of two men — one who died — in a car outside the Roosters Restaurant on North Main Street isn’t classified as justifiable homicide, but said the facts of the case made it “appropriate” for the federal system.

Dayton police said Leo Montgomery III, 21, died of gunshot wounds and Evon Walker was shot but survived after police say Martin fired at them on Dec. 2, 2016.

A spokeswoman for the Montgomery County Prosecutor’s Office confirmed that Martin’s state case was terminated March 7 without being reviewed by a three-prosecutor panel.

It appears the federal prosecution even though self-defense is because he was a drug dealer or it apears so. 

Never Wise To Use A Gun When You Are A Prohibited Person

A fatal shooting last week in Clairton may be treated as a case of justifiable homicide, police said.

Aaron Barrow, 19, of McKees Rocks was killed at about 1 a.m. Thursday when he was shot multiple times during a home invasion in the city's Wilson neighborhood. 

Allegheny County police Lt. Andrew Schurman said Tuesday three men who were in the home at the time of the robbery attempt were arrested but none has been charged with homicide. 

Jaime Mosqueda, 39, a resident of the home at the corner of Pennsylvania and Ohio avenues, was arrested on three counts of prohibited acts and single counts of conspiracy, persons not to possess a firearm, offensive weapons and false identification. 

He is jailed on $100,000 bail. 

Oswaldo Cuero Guerrero, 27, of Houston and Anthony Gardner, 20, of South Park were charged with two counts of prohibited acts and single counts of conspiracy, prohibited acts and offensive weapons.

Even Bad Guys Defend Themselves

The death of Everette — whose body was found off Murrill Hill Road after a “drug deal gone bad” spurred gunfire early Monday morning — did not merit a murder charge, Onslow County Sheriff Hans Miller said.

The act was ruled self-defense.

Because both men were convicted felons, the survivor faces one charge of felon in possession of a firearm, Miller said. Everette’s convictions included possession of stolen goods and possession of a Schedule 2 controlled substance. The man who allegedly acted in self-defense — Delman Dwayne Dixon, 22 — previously was convicted of common-law robbery, breaking and entering and obtaining property by false pretense, according to N.C. Department of Public Safety.
