Burglary suspect remains hospitalized after being shot
A burglary suspect remains hospitalized after being shot early Thursday morning.
Investigator Larry Elkin with the Rogers County sheriff’s office said Benjamin James Marshall, 22, was shot in the chest with a .45 caliber handgun.
Richard Young, 65, shot Marshall after he allegedly discovered Marshall in his business at 24906 S. Highway 66. The business is listed as B&S Light Industries.
Marshall had allegedly broken into the building and Young confronted him through a window.
Elkin said Young stated Marshall was making “aggressive moves” and Young feared Marshall was going for a weapon.
Young fired on Marshall, striking him once under the arm. Marshall was taken to St. Francis Hospital where he was treated for a single gun shot wound.
Elkin said the exterior lights at the business had been broken out, apparently by Marshall.

After the incident, sheriff’s deputies attempted to contact Marshall’s father, James Kirk Marshall, but were advised he was currently in prison serving time for manufacturing methamphetamine.
