El Paso, TX

2/17/23 Fox News:

Police in El Paso, Texas say that a "licensed-to-carry" bystander shot the alleged gunman who is accused of killing one person and injuring another three.

The suspect, a 16-year-old Hispanic male, is accused of shooting the individuals after a "confrontation ensued" between two groups at Cielo Vista Mall on Wednesday evening at 5:05 p.m.

The El Paso Police Department said the confrontation eventually escalated into a "physical fight," and the 16-year-old pulled out a handgun, fatally shooting Angeles Zaragoza, 17, and injuring another 17-year-old and 15-year-old.

Police say that Emanuel Duran, 32, who is a licensed-to-carry holder, shot the suspect as he was pointing his gun toward the direction of more bystanders....

Investigators learned there were "at least" two more people who were legally armed, but weren't involved in the shooting.

Houston, TX

1/6/23 KHOU:

HOUSTON — A customer at Ranchito Taqueria shot and killed a man who robbed the restaurant in southwest Houston late Thursday night, according to the Houston Police Department.

It happened just before 11:30 p.m. Thursday at the restaurant on S. Gessner near Bellaire Boulevard.

Houston police said the armed man in a mask came inside the restaurant, demanding money and wallets from customers. However, as he was leaving, one of those customers shot the suspect.

As this analysis at Legal Insurrection observes the first eight shots fired either clearly or ambiguously meet the definition of lawful self-defense.  The 9th shot to an inert and disarmed person's head did not.

It is still a lawful self-defense until that point.

Deputies responded to multiple reports of gunshots at about 6:20 a.m. near 12100 Mountain Daisy. When they arrived at the neighborhood, deputies say the victim, Joseph Wiltz, had suffered a gunshot wound and they provided lifesaving measures.

Wiltz was transported to a hospital and pronounced dead.

After investigating, officials revealed that Wiltz came to his ex-girlfriend's house and began assaulting her, stemming from domestic violence.

Official say that the woman's son, 27-year-old Javon Small, stepped outside of the home and saw Wiltz trying to get his mother out of her car. Small shot the suspect when he fell off the car and began approaching him.

The full case was presented to the Harris County District Attorney's Office, who declined to file any charges in the case. The case will be presented to a grand jury for review.

The case is listed as a justifiable homicide.

Lubbock, TX

 11/25/21 New Zealand Herald:

Lawyers for a Texas man who shot and killed a woman's ex-husband after a heated confrontation outside their home say the killing was a "justifiable homicide" under the state's self-defence laws.

Police have not laid any charges against William "Kyle" Carruth, who shot and killed Chad Read, 54, in the north-western city of Lubbock on November 5, local media reported.

Two videos of the deadly incident, one released by Read's widow and one by Carruth's lawyers, depict the confrontation between the two men moments before the shooting.

In the videos, Read is seen arguing with a woman, identified as his ex-wife, over a child custody issue.

Carruth tells Read to leave, before stepping back inside the house and returning with a gun.

The men go head-to-head as Read yells at Carruth to "use it, motherf***er because God damn it I'll take it from you and f***ing use it on you".

Carruth steps back and fires a shot into the ground.

Read then grabs the gun and swings Carruth, who steps back off the porch and fires two shots, killing the other man.
